Terms of Service

The rules of the road. Please read these terms carefully before using Episode.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Episode Ltd., a company registered in England and Wales ("Episode," "we," "us," or "our"), governing your access to and use of the Episode platform at www.useepisode.com, including our landing page builder, AI generation tools, A/B testing engine, publishing and rendering services, integrations, and all related features (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 16 years old to use the Service. By using Episode, you represent and warrant that you meet this age requirement. If you are between 16 and 18 years old, you confirm that you have your parent or guardian's permission to use the Service.

3. Account Registration and Security

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your password and for all activity under your account
  • You must notify us immediately at support@useepisode.com if you suspect unauthorized access to your account
  • We reserve the right to suspend or terminate accounts that provide false information or violate these Terms
  • One person or entity may not maintain more than one free account

4. The Service

4.1 What Episode Provides

Episode is a platform for creating, publishing, testing, and optimizing landing pages. The Service includes:

  • AI-powered page generation: Generate landing page content and layouts from natural language descriptions using AI models
  • Visual builder: Edit, customize, and arrange sections of your landing pages
  • Publishing: Publish your websites to Episode subdomains (*.useepisode.site) or your own custom domains
  • A/B testing: Run section-level A/B tests with automatic variant promotion and demotion
  • Analytics: View page-level and section-level performance metrics, conversion data, and test results
  • Forms and lead capture: Create and manage forms with spam protection, validation, and delivery to email, webhooks, or CRM integrations
  • CRM and marketing integrations: Connect to HubSpot, Salesforce, Mailchimp, Zoho, Freshworks, Brevo, Google Sheets, and Notion to sync leads and form submissions
  • Vision Analysis: Extract brand information from URLs or documents to generate brand-matched pages

4.2 AI-Generated Content

Content generated by our AI tools is created based on your inputs and prompts. While we strive for high-quality output, AI-generated content may contain inaccuracies, errors, or content that does not meet your expectations. You are responsible for reviewing, editing, and approving all AI-generated content before publishing. Episode does not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose.

4.3 Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. We may perform scheduled or emergency maintenance that temporarily affects availability. We will make reasonable efforts to notify users in advance of planned downtime.

5. Subscription Plans and Billing

5.1 Plans

Episode offers the following subscription tiers:

  • Free: 1 website, 35 AI credits/month, basic analytics, Episode branding
  • Basic ($25/month or $250/year billed annually): Up to 5 websites, 200 AI credits/month, custom domains, analytics, community support
  • Pro ($60/month or $600/year billed annually): Up to 25 websites, 1,000 AI credits/month, advanced analytics, up to 5 team members, API access, priority support

Current plan limits, included credit allocations, and add-on credit pricing are listed on our pricing page and may be updated from time to time on prospective notice as described below. The figures above are accurate as of the "Last updated" date at the top of these Terms.

We reserve the right to modify pricing, features, or plan limits with 30 days' prior notice. Price changes will not apply to your current billing period.

5.2 AI Credits

AI credits are consumed when you use AI-powered features such as page generation, Figma design imports, and Vision Analysis. Each plan includes a monthly credit allocation that resets on your billing date. Unused credits do not roll over between billing periods. Additional credits may be purchased separately. In-progress AI operations are never interrupted; credits are deducted upon completion.

5.3 Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis through Stripe
  • By subscribing, you authorize us to charge your payment method on a recurring basis
  • If payment fails, we may suspend access to paid features until payment is resolved
  • All prices are in US dollars unless otherwise stated
  • You are responsible for any applicable taxes

5.4 Refunds

If you are not satisfied with a paid plan, you may request a refund within 30 days of the start of your current billing period (i.e., the initial purchase or the most recent renewal). Refunds within this window are calculated on a pro-rata basis: we refund the portion of the period that has not yet elapsed at the time we receive your request. After 30 days, subscriptions for the current billing period are non-refundable. To request a refund, contact us at support@useepisode.com.

Purchased AI credit packs are non-refundable once any credits from the pack have been used. Wholly unused credit packs may be refunded within 30 days of purchase.

UK and EU consumer cancellation right. If you are a consumer based in the United Kingdom or the European Economic Area, you have a statutory right to cancel your subscription within 14 days of the initial purchase under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the EU Consumer Rights Directive, as applicable. By starting to use the Service immediately upon subscribing (including generating AI content, publishing websites, or otherwise consuming credits), you acknowledge that performance of the Service has begun within the cancellation period. Where you have consumed part of the Service before cancelling, we may deduct an amount proportionate to what has been supplied. Our 30-day refund policy above is offered in addition to, and does not limit, this statutory right.

5.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, your paid plan remains active until the end of your current billing period, after which your account reverts to the Free plan. Published websites that exceed Free plan limits may be unpublished.

6. Your Content and Responsibilities

6.1 Ownership

You retain all ownership rights to the content you create, upload, or generate using the Service, including website copy, images you upload, form configurations, and design choices. Episode does not claim ownership of your content.

6.2 License to Episode

By using the Service, you grant Episode a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and distribute your content solely for the purpose of operating and providing the Service. This includes rendering your published websites to visitors, processing your content through our AI tools, and delivering form submissions. This license terminates when you delete your content or close your account.

6.3 Your Responsibilities as a Publisher

When you publish websites through Episode, you are the publisher. You are solely responsible for:

  • Ensuring your website content complies with all applicable laws and regulations
  • Providing appropriate privacy notices to your website visitors, especially if you collect personal data through forms
  • Obtaining necessary consents from your website visitors for data collection and processing
  • Complying with applicable data protection laws (GDPR, CCPA, etc.) as a data controller for visitor data
  • Ensuring any third-party tracking scripts you add (Google Analytics, Facebook Pixel, custom scripts) comply with applicable laws
  • The accuracy and legality of all claims, offers, and representations on your published websites

7. Acceptable Use

You agree not to use the Service to:

  • Publish or distribute content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable
  • Publish content that infringes on intellectual property rights, privacy rights, or any other rights of third parties
  • Create phishing pages, scam websites, or pages designed to deceive visitors
  • Distribute malware, viruses, or any other harmful code through published websites or custom scripts
  • Send spam or unsolicited communications through form delivery or webhook features
  • Attempt to gain unauthorized access to the Service, other users' accounts, or our infrastructure
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Use the Service to violate any applicable local, state, national, or international law or regulation
  • Scrape, crawl, or use automated means to access the Service beyond normal API usage
  • Resell, sublicense, or redistribute the Service without written permission
  • Publish content promoting illegal activities, violence, discrimination, or exploitation
  • Use AI generation features to create deceptive, misleading, or harmful content at scale
  • Abuse AI credits through automated or scripted generation requests

We reserve the right to remove content and suspend or terminate accounts that violate these acceptable use guidelines, with or without notice.

8. Custom Domains

  • Custom domain support is available on Basic and Pro plans
  • You must own or have authorization to use any custom domain you connect to Episode
  • You are responsible for maintaining domain registration and DNS configuration
  • We provide automatic SSL certificates for connected custom domains
  • We are not responsible for domain registration, renewal, or DNS-related issues outside our platform

9. Integrations

Episode integrates with third-party services including HubSpot, Salesforce, Mailchimp, Zoho, Freshworks, Brevo, Google Sheets, Notion, and Figma. When you enable an integration:

  • You authorize us to transmit data to the connected service according to your field mapping configuration
  • You are responsible for complying with the third party's terms of service and data policies
  • We do not guarantee the availability, accuracy, or security of third-party services
  • You may disconnect integrations at any time, which will stop future data transfers but will not delete data already sent to the third party
  • Figma imports: When you connect your Figma account, we access your design file metadata, design trees, and exported images to convert them into website sections. Imported designs are processed by AI (Anthropic Claude) for visual refinement. Figma access tokens are stored encrypted and can be revoked at any time from Settings

10. Intellectual Property

10.1 Episode's IP

The Service, including its design, code, features, documentation, branding, logos, and all underlying technology, is owned by Episode Ltd. and protected by intellectual property laws. These Terms do not grant you any rights to Episode's intellectual property except the limited right to use the Service as described herein.

10.2 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate that feedback into the Service without any obligation to you.

10.3 DMCA and Copyright Complaints

We respect intellectual property rights. If you believe content published through Episode infringes your copyright, please contact us at support@useepisode.com with: (a) identification of the copyrighted work, (b) identification of the infringing material and its location, (c) your contact information, (d) a statement that you have a good faith belief the use is unauthorized, and (e) a statement under penalty of perjury that your claim is accurate and you are authorized to act on behalf of the copyright owner.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, Episode disclaims all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Any warranty that the Service will be uninterrupted, error-free, or secure
  • Any warranty regarding the accuracy, completeness, or reliability of AI-generated content
  • Any warranty that A/B test results will improve your conversion rates or business outcomes
  • Any warranty regarding the performance, uptime, or availability of published websites

You acknowledge that AI-generated content may contain errors and that you are solely responsible for reviewing and approving all published content.

12. Limitation of Liability

Nothing in these Terms excludes or limits Episode's liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot lawfully be excluded or limited under the laws of England and Wales, including your statutory rights as a consumer under the Consumer Rights Act 2015 and any non-excludable rights under applicable EU consumer protection law.

Subject to the paragraph above, and to the maximum extent permitted by law, Episode and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service, regardless of the cause of action or theory of liability.

Subject to the first paragraph of this Section 12, Episode's total aggregate liability for any claims arising under these Terms shall not exceed the greater of: (a) the amount you paid to Episode in the 12 months preceding the event giving rise to the claim, or (b) $100 USD.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Episode and its officers, directors, employees, and agents from and against any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Content you create, publish, or distribute through the Service
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third party's rights, including intellectual property, privacy, or publicity rights
  • Claims made by visitors to your published websites that arise from your content, configuration, or data handling (and not from a defect in the underlying Episode platform)

Where the law of your country of residence β€” including mandatory consumer protection law in the United Kingdom, the European Economic Area, or other jurisdictions β€” limits or prohibits a consumer's liability under an indemnity of this kind, this Section 13 applies only to the extent permitted by that law and does not affect any rights you have that cannot be excluded or limited by contract.

14. Termination

14.1 Termination by You

You may stop using the Service and close your account at any time by contacting us at support@useepisode.com or through your account settings. Published websites will be taken offline upon account closure.

14.2 Termination by Episode

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You violate these Terms or our Acceptable Use policy
  • Your account is involved in fraudulent or illegal activity
  • You fail to pay outstanding fees after reasonable notice
  • Continued provision of the Service to you is commercially impractical

14.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • Published websites will be taken offline
  • We will retain your data for 30 days to allow account recovery, after which it will be permanently deleted
  • Provisions of these Terms that by their nature should survive termination will survive (including liability limitations, indemnification, and governing law)

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal legal action, you agree to contact us at support@useepisode.com and attempt to resolve the dispute informally for at least 30 days.

15.2 Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. This does not affect any mandatory consumer protection rights you may have under the laws of your country of residence.

15.3 Jurisdiction

Any legal action or proceeding arising under these Terms shall be brought in the courts of England and Wales. If you are a consumer based in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you are resident. If you are a consumer based in the European Economic Area, you may also bring proceedings in the courts of your country of residence. Nothing in this Section 15 deprives you of the protection afforded to you by provisions of the law of your country of residence that cannot be derogated from by agreement.

16. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Episode regarding the Service
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect
  • Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision
  • Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely in connection with a merger, acquisition, or sale of assets
  • Force majeure: We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, internet outages, government actions, or third-party service failures
  • Notices: We may send you notices via the email address associated with your account. You may send us notices at support@useepisode.com

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the revised Terms.

If you do not agree with the updated Terms, you may close your account before the changes take effect.
